An Orleans homeowner bought a house with a "finished basement apartment" in 2018. Their first tenant moved out four years later, and when they tried to re-rent, they found out the unit had never been permitted, and that the previous owner had built it themselves in 2014 without inspections.
The headroom in the bedroom was 1.85 m. The egress window was 16 x 24 inches. There was no fire separation between the basement and the rest of the house. The smoke alarms were battery-only. None of it was legal, and the new tenant pool now asks for a copy of the rental property licence before signing.
Legalizing an existing basement suite is the most common project in our queue. Here is how the rules apply specifically to basements, and what it actually costs.
Why Basements Are Trickier Than Above-Grade Suites
An above-grade rental suite, like a finished attic or a side-split addition, can be designed to current code from the start. The walls go up tall enough, the windows are sized properly, the floors are joisted to handle the load.
A basement is the opposite. The headroom, the slab, the joist depth, the existing footing, the mechanical layout, and the existing windows are all decisions made by a builder 30-70 years ago for a different use. Legalizing a basement means working within those constraints, or accepting expensive modifications.
The good news: Bill 23 and the matching changes to Ottawa Zoning By-law 2008-250 made the legal pathway easier than ever. The bad news: the building code rules did not loosen, and a basement that was illegal in 2010 is still illegal today.
Headroom: The 2.0 m Rule
OBC 9.5.3.1 sets the minimum ceiling height in living rooms, kitchens, dining rooms, and bedrooms at 2.1 m (6'-11"). For renovations of existing basements, the OBC allows a reduction to 2.0 m (6'-7") in living and sleeping spaces, with 1.95 m (6'-5") permitted under beams that are spaced no closer than 1.2 m apart.
Hallways, bathrooms, and laundry rooms can go to 1.95 m.
Most Ottawa houses built before 1990 have basement headroom of 1.95-2.05 m at the lowest joist. Houses built 1990 onward usually have 2.10-2.30 m. If your basement clear height is below 1.95 m anywhere a person regularly stands, you have three paths:
- Underpinning. Lower the basement slab by digging out the perimeter footings and pouring new ones below. Adds 12-24 inches of clear height. It is the most expensive headroom option, priced by the linear foot of perimeter, so the longer the perimeter the larger the job.
- Bench footing. A poured concrete bench inside the existing footing, with the centre of the slab dropped between benches. Less expensive than underpinning, but eats interior floor area.
- Use the basement as designed and accept lower-end finishes. If you have 1.95 m honest, the unit is legal. If a buyer or tenant wants 8-foot ceilings, this is not the unit for them.
Heads up
Headroom is measured from the finished floor to the underside of the lowest projecting structural member, including ductwork, beams, and plumbing soffits. Adding a 1-inch sleeper subfloor and a 1/2-inch finish floor reduces headroom by 1.5 inches. Plan for the finish heights at the design stage, not after framing.
Egress Windows in a Basement
Every bedroom and any sleeping area in the basement requires an egress window per OBC 9.9.10:
- Minimum 0.35 m² openable area (3.77 sq ft)
- No dimension less than 380 mm (15 inches)
- Sill height max 1.5 m above the finished floor
- Window well outside, at least 760 mm clear, drained to a sump or weeper
- If the well is more than 1.5 m deep, a permanent ladder is required
Most Ottawa pre-1990 basements have small horizontal hopper windows around 24 x 18 inches, with about 0.18 m² of opening. Not legal. The fix is cutting the concrete to enlarge the opening, installing a structural lintel, fitting a code-sized casement or slider, and installing a window well outside.
Cost per opening depends on the foundation thickness, the lintel design, and the window-well drainage. A typical two-bedroom basement suite needs two egress windows.
Fire Separation Between the Suite and the Upstairs
OBC 9.10.9.14 requires a continuous 1-hour fire separation between the basement dwelling unit and the rest of the house, unless a residential sprinkler system is installed (which drops the rating to 45 minutes).
What that looks like in practice for the basement ceiling:
- Two layers of 5/8" Type X drywall on the underside of every joist, screwed to a schedule that matches the listed assembly
- Mineral wool sound insulation in the joist cavity
- All joints in the drywall layers staggered, taped, mudded
- Continuous to the perimeter walls; no gaps at the rim joist
- Firestop sealant around every plumbing, electrical, and HVAC penetration
- Listed firestop collars on plumbing stacks
- Fire dampers in any duct that crosses the separation
The stair separation is its own challenge. If the basement entry stair is shared with the upstairs unit, the stair walls and underside need to be fire-rated, and the doors at top and bottom of the stair have to be 20-minute self-closing, self-latching doors. If the stair is interior to the basement unit only, the rating sits at the basement-to-main-floor line.
A clean 1-hour separation in a typical 800-1,200 sq ft Ottawa basement is driven by the amount of ceiling and shared-wall area, the number of penetrations to firestop, and the stair detailing, all before any finish.
Separate Entrance for the Basement Unit
Every legal dwelling unit needs an independent entrance. For a basement suite, the options:
- Walk-out at grade. Common on side-split or back-split houses where the rear yard slopes down. The cleanest, cheapest option if it exists naturally.
- New exterior stair from grade down to a basement door. Requires excavation, retaining walls, drainage, and a frost-protected stairwell. It is the most involved entrance option, driven by excavation depth and site access.
- Shared interior entry through a fire-separated vestibule. Sometimes acceptable, sometimes not, depending on how the existing layout is configured. Requires the vestibule to be fire-separated from both units and to have direct exterior access.
The "tenant walks through your kitchen to get to the stair" arrangement is not a legal separate entrance. The unit fails the test.
Smoke Alarms, CO, and ESA
Hardwired and interconnected smoke alarms are required throughout both units, per OBC 9.10.19. Carbon monoxide alarms are required in any room used for sleeping in a unit that contains a fuel-burning appliance, plus adjacent to the appliance.
The Electrical Safety Authority (ESA) is the other agency you have to deal with. Adding a basement suite usually means:
- Subfeed panel for the suite (or a fully separate service)
- Independent metering if you want to bill the tenant separately
- ESA notification at rough-in, and a final ESA inspection certificate
- AFCI and GFCI breakers per current code on every circuit
An ESA certificate is a permit-stage requirement and is non-negotiable. The final permit closing will not happen without it.

What Drives the Cost to Retrofit an Existing Illegal Basement
Three scope tiers explain most of what moves the budget on projects we have done:
- Light retrofit: headroom is OK, existing windows are close to egress, and fire separation is partial. The least expensive path, mostly drywall, finishes, and alarm upgrades.
- Standard retrofit: egress windows need cutting, fire separation needs a full ceiling, and a separate entrance needs creating. This is where most Ottawa illegal basements land.
- Heavy retrofit: headroom needs underpinning or benching, full mechanical separation, and an exterior stairwell. The most expensive path, driven by structural and excavation work.
